Roundtable on optimizing the process of amicable dispute resolution

The National Institute of Justice and the Council of Mediation, with the support of USAID Moldova, organized a roundtable today, October 25, 2024, entitled "Improving mechanisms for confirming and enforcing transactions in which parties agreed on amicable dispute resolution."

The event brought together judges, mediators, as well as representatives from the Ministry of Justice and the Council of Mediation, facilitating a constructive dialogue on optimizing both the procedure for confirming transactions concluded to prevent civil disputes and the procedure for issuing enforcement titles.

The roundtable, moderated by Felicia Chifa, PhD in law, university lecturer, and mediator, began with welcoming remarks from the Ad interim Director of the National Institute of Justice, Adrian Cerbu, the Head of the legal professions and services Directorate of the Ministry of Justice, Angela Maxim, and the President of the Council of Mediation, Marcel Burlacu.

In his speech, the Ad interim Director of the National Institute of Justice, Adrian Cerbu, highlighted the importance of interaction between judges and mediators, two professions that, although distinct, are complementary within a modern, efficient legal system focused on the needs of litigants.

The roundtable addressed issues regarding the institution of mediation and transactions concluded with the involvement of a mediator.  In particular, it examined the legal limits of agreements and the current challenges regarding their confirmation by the courts. During the discussions, some conclusions and recommendations were outlined for improving the procedural framework.

The event is part of the Action Plan for implementing the Strategy for Ensuring the Independence and Integrity of the Justice Sector for the years 2022–2025.
