On November 11 and 12, 2024, at the National Institute of Justice, two seminars on developing skills in drafting judicial and procedural documents were organized. The activities respond directly to the recommendations of the TAIEX mission of 2022, which emphasizes the need to increase the quality of decision drafting and legal reasoning by incorporating this dimension into the initial training curriculum.
The training sessions were facilitated by trainers from the National Institute of Magistracy of Romania - Ionut Victor Voina, judge at the Bucharest Court of Appeal - Criminal Section II, and Vasile Bozesan, judge at the Ilfov Court of Ilfov.
On the first day, the training program was addressed to NIJ trainees, and on the second day the activities were held with the participation of the candidates to the positions of judge and prosecutor who were enrolled in studies this year.
During the seminars, key aspects of the drafting court decisions were addressed, with an emphasis on the structure and reasoning of decisions on pre-trial detention, including the analysis of practical situations. At the same time, the methodology of logical structuring of the argumentation of judgments in the civil field and the ways of capitalizing on the case law of the European Court of Human Rights in their substantiation were presented.
The training activities are part of the project "Assistance in the field of justice - Strengthening the institutional capacity of the National Institute of Justice of the Republic of Moldova", implemented by the National Institute of Magistracy of Romania and the National Institute of Justice of the Republic of Moldova, funded by the Romanian Government - Ministry of Foreign Affairs through the International Development Cooperation Agency.
