The European Court of Human Rights, the spirit promoted by this high judicial body and the consistent jurisprudence in affirming the values of the European Convention were central elements of the meeting of the NIJ trainee of the National Institute of Justice with ECtHR judges from the Republic of Moldova and Azerbaijan - Diana Sârcu and Lətif Hüseynov. The event took place today, April 11, 2022.
In the opening remarks, Ecaterina Popa, ad Interim Director of the NIJ, expressed her conviction that the subject approached will arouse curiosity of future judges and prosecutors, which must take into account fundamental human rights and freedoms, and the jurisprudence of the Strasbourg Court when specific cases will be investigated and examined.
The meeting took the form of a dialogue about professional experience, the influence of previous activity in the mandate of a judge at the ECtHR, the usefulness of separate opinions, compensatory mechanisms in case of violation of the rights guaranteed by the Convention, how to increase society's trust in justice.
Also today, at the headquarters of the Supreme Court of Justice, were held discussions between the ECtHR judges and magistrates and legal assistants of the SCJ. The national judges have shown interest in issues related to the reasonable time of a file case and the independence of the judge, the legal consequences and the status of the cases in which the Russian Federation and Transnistria are involved after the adoption of Resolution CM / Res (2022) 2.
Diana Sârcu, university professor, Doctor habilitatus in Law, former Director of the National Institute of Justice during the period 2015-2021. In September 2021, she was elected by the Parliamentary Assembly of the Council of Europe as a judge of the European Court of Human Rights on behalf of the Republic of Moldova.
Lətif Hüseynov, university professor, Doctor of Legal Science, Member of the European Commission against Racism and Intolerance (ECRI), 2001-2007; Member of the Venice Commission, 2003-2016; Member of the Advisory Committee of the UN Human Rights Council, 2008-2014; President of the European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (CPT) 2011-2015. Since, 4 January 2017, he has been a judge of the European Court of Human Rights on behalf of the Republic of Azerbaijan.
