On Monday, July 2, 2018, two teams formed by representatives of two different classes of NIJ trainees, have demonstrated the skills required in the frame of a simulated court trial before the European Court of Human Rights (ECtHR).
During the competition, which is held for the first time within the National Institute of Justice, the former and actual NIJ trainees acted as applicants, Government’s representatives, third parties and simulated the trial of a case before the European Court. The exercise offered the participants the possibility to undertake a deep research in a sensible, but very important field for the contemporary society - the right to a healthy environment. Under this aspect, the European Court’s case-law represents an important source when it comes to the interpretation and application of the Convention, in a manner that the right to a healthy environment is protected as a fundamental human right.
At the assessment of the participants’ performances, the jury, formed by Diana Scobioala, doctor habilitatus in Law, the NIJ Director, Oleg Rotari, the Governmental Agent of the Republic of Moldova before the ECtHR, Alexandra Nica, the Head of the Training and research division, NIJ, Olga Dorul, doctor in Law, Victoria Sanduta, judge within the Chisinau Court, Valentin Rosca, doctor in Law, has taken into consideration the following criteria: the originality of the presentation, the notable reasoning of the expressed opinion, the correctness of the terms used and the proper legal language.
In the frame of the simulated activity, all the participants have demonstrated the knowledge and skills that are necessary for the application of the ECtHR’s standards. Still, the future candidates to the positions of judge and prosecutor have proven to be more convincing in the elaboration of the procedural acts and in their pleadings before the audience.
