On Tuesday, June 13, 2023, at the National Institute of Justice, the public lesson was held by the trainer of the National Institute of Magistracy of Romania, university professor, PhD Radu Alexandru Rizoiu, with the title „The age of sufficient or overabundant reason? About the reasoning of the decision and the indictment”. The event was attended by NIJ trainees, candidates to the positions of judge and prosecutor.
The chosen topic focused, from theoretical and practical perspectives, on the importance of reasoning, as a basic element that determines the quality of a judgment, types of reasoning (form, fund and structure) and argumentation (in fact, by law, the issue of motivation as justification and not as reasoning). Topics related to the structure of judicial syllogism and the court's obligation to state reasons for its judgments by: the establishment of the factual situation presented in detail, the legal framework, the examination of the arguments of the parties, the point of view of the court towards each relevant argument, the logical-legal reasoning that substantiated the adopted solution.
It should be noted that strengthening the capacity of legal professionals on judicial reasoning is one of the priorities of the National Institute of Justice, with increased attention to the drafting and motivation of procedural acts both as an integral part of mock trials in which NIJ trainees are involved and as a separate discipline for them. The HELP course „Judicial reasoning and human rights” was also adapted to the national order and institutionalized for the beneficiaries of the Institute.
